How to Get a Patent in India?

A patent is, by the broadest of definitions, an intellectual property. Now, what’s intellectual property? Let's say someone came up with an idea and told another about the same. The one being told the idea can now use the same idea as their own for commercial purposes. To prevent this from happening, the original owner patents the idea as his or her own Intellectual property. Patents can last up to a couple of decades depending on various circumstances.   • Grant Patent: The patent is granted to one seeking it only if the officer couldn't find any misrepresentations or problems with the applications.

Once the patent is granted there are various rights that the patentee can enjoy, which can be put sufficiently within the three key pointers:

  • Right to exploit the patent:One who has the patent has exclusive right to manufacture, hire and sell as they wish. The number of manufacturing units, the number of products and who to sell and where to deliver are all decided by the one who possesses the ownership of that particular patent.

  • Right to assign and Sell:The one that has the patent can easily give the rights to someone else in order the manufacture on their behalf. This is known as assigning the patent. The patent once taken can also be sold to the highest bidder. Large companies these days offer large sums of money to smaller organisations when they see potential in the product they’re selling out in the market.

  • Right to surrender:Like any other item owned by any individual, the owner also has the right to dispose of the patent, whenever they feel like it. That is the best possible feature of getting yourself a patent as it is quite easy to discard.
